Currently I'm serving 17 to 22 years from being seriously wrongfully convicted through allegations of indecent liberties with a minor and attained the status of habitual felon as an an enhancement on my sentence due to prior conviction that's not related. I was arrested and initially charged with first degree rape of a child and statutory rape of a child. Allegations was made by my daughter's older sister who was 9 years old at the time, claiming to been rape through vaginal penetration since the age 7. Medical screening and rape kit results had contradicted the allegations 4 months after my arrest. The prosecutor refused to drop charges even after the fact. 22 months after my arrest I appeared for trial on those offenses but the prosecutor motioned for a continuance to seek indictment for a less severe offense but have the sentencing structure enhance from a H class felony to a C class felony to give me just as much time by having me indicted on the habitual felon status. This was sought due to the prosecutor assertion that I was wrongfully charged with rape offenses because of professionals misinterpretation of the statement made by the alleged victim when interviewed. Although there was no misinterpretation due to it not being officially confirmed by those professionals and a video recorded children medical evaluation that was conducted displaying the alleged victim's making allegations that was cut and dry of being vaginal penetrated, prosecutor stated that 3 days prior during a trial prep with the called victims, she disclosed that there was no vaginal penetration when molested. The recantation of the alleged victim's statement allowed the prosecutor to change the offense being that there was no evidence of rape to obtain a conviction due to needing proof of penetration, which is an element that has to be proven of that offense for a conviction. With the prosecutor obtaining an indictment for indecent liberties with a minor, it gives a better chance for a conviction being that the elements of the offense don't have to be physically proven and conviction can be obtained by word of mouth of the accusor. The judge that resided that day ruled for a continuance and instead of being released as I should, I was still held under the same offense until I was indicted on the new offense, even after the prosecutor admitting that I was wrongfully charged. Trial was rescheduled for the next following month and I was charged with 4 counts of indecent liberties with a minor and attained the habitual felon status through a superseding indictment by the grand jury. altogether I was facing 10 years at least for each count due to the enhancement of the sentencing structure due to being a habitual felon. I was offered a plea of 10 years but turned it down to proceed with trial to prove my innocence. I appeared for trial under those offenses and was found guilty not because of physical evidence due to it not being any but through the emotions of the jurors whose passion was inflamed by testimony's about the issues the alleged victim's mother and I had in our relationship, abuse, financial problems and poor parenting on my end. This caused the jurors to become bias and overlook the inconsistencies, contradictions, and facts that would exonerated me. Being that 65% of the jurors was women and I was tried during the "Me Too" movement, the olds was stacked against me. There's indications within my case that implicates a clear motive behind the allegations in order to have me removed from the home and out the lives of love ones. There's no doubt in my mind of the alleged victim being manipulated and coerced by a close relative to fulfil this plot on the behalf of my child's mother and her children well being and safety. Not only my conviction was obtained through lies, contradictions, and recantation, but through injustice of the criminal system.
